“Happy Birthday to You” にcopyrightなし




誕生日のたびに歌われる歴史上最も有名な “Happy Birthday” song。この元歌は“Good Morning To All.” この歌に copyright(著作権、版権)を主張してきた Warner/Chappell に対し、米ロサンゼルスの連邦地裁は、版権所有に基づく課金の権利を退ける判決を下した。

ロサンゼルス・タイムス(9月22日付)は “All the 'Happy Birthday' song copyright claims are invalid, federal judge rules”(すべてのハッピー・バースデー・ソングの版権請求は無効、連邦裁判事裁定)と報じた。


The story began in 1893, with a Kentucky schoolteacher and her older sister. Patty Smith Hill and Mildred J. Hill wrote the song for Patty’s kindergarten students, titling it “Good Morning To All.” The original lyrics Patty wrote were: “Good morning to you / Good morning to you / Good morning, dear children / Good morning to all.”(この話は1893年、ケンタッキーの学校教師とその姉から始まった。パティ・スミス・ヒルとミルドレッド・J・ヒルが、パティの幼稚園の生徒のために、“Good Morning To All”という題で歌を書いたのだ。パティが書いた歌詞は、“Good morning to you / Good morning to you / Good morning, dear children / Good morning to all.”

The sisters published the song in a book called “Song Stories for the Kindergarten,” and assigned the copyright to their publisher, Clayton F. Summy Co., in exchange for a cut of the sales.(姉妹は『幼稚園のための歌の話』という本の中で歌を出版し、版権を売上の一部との交換で、Clayton F. Summy Co. に委ねた)

ところが、Warner/Chappell が 1988年に Clayton F. Summy Co. の後継者の Birch Tree Group を買収し、この歌の権利も手に入れたとして訴訟に及んだというわけ。

Warner and the plaintiffs both agreed that the melody of the familiar song, first written as "Good Morning To All," had entered the public domain decades ago. But Warner claimed it still owned the rights to the "Happy Birthday" lyrics.(ワーナーと原告の双方は、最初に "Good Morning To All” として書かれた、なじみ深い歌のメロディーは、すでに何十年もまえに公有に属していると認めている。しかし、ワーナーは『ハッピー・バースデー』の歌詞の権利は所有している、と主張した)

だが、この歌詞を書いたのは、あの姉妹なのか誰なのかは、わからない、という。


これが現代の著作権ビジネスの深層である。
